MooseMailer Policies

MooseMailer is a service operated by BrenCor Digital Enterprises Inc.

Anti-Spam Policy

Effective: January 2025

MooseMailer is committed to responsible email marketing. We take spam seriously — not just because it's the law, but because it protects our customers, their subscribers, and the reputation of everyone on our platform.

This policy outlines what we expect from every MooseMailer user. By using the Service, you agree to follow these rules. Violations may result in account suspension or termination.

1. Permission Is Required

You must have valid consent before sending any commercial email through MooseMailer. This means every person on your list has either:

  • Expressly opted in — They signed up, checked a box, or otherwise clearly agreed to receive your emails
  • Given implied consent — They have an existing business relationship with you (such as a recent purchase or inquiry) that reasonably allows contact

Under Canadian law (CASL), implied consent expires. If someone hasn't heard from you in over 12 months, you need fresh permission before emailing them again.

2. Prohibited List Sources

The following are never acceptable:

  • Purchased or rented contact lists
  • Scraped or harvested email addresses
  • Lists obtained from third parties without explicit, documented consent
  • Contacts collected through deceptive means
  • Lists shared or traded with other businesses

If you didn't collect the email address yourself — with clear consent — don't use it.

3. What Every Email Must Include

Every commercial message sent through MooseMailer must contain:

  • Clear sender identification — Your "From" name and email address must accurately represent you or your business
  • Honest subject lines — No misleading, deceptive, or clickbait subject lines
  • Your contact information — A valid physical mailing address, plus a way to reach you electronically (email, phone, or contact page)
  • A working unsubscribe link — Every email must include a clear, easy-to-use way to opt out

MooseMailer automatically adds an unsubscribe link to your emails. Please don't remove or hide it.

4. Unsubscribe Requests

When someone unsubscribes:

  • The request must be honoured within 10 business days (CASL requirement)
  • MooseMailer processes most unsubscribes immediately and automatically
  • You must not email that person again unless they re-subscribe
  • Unsubscribe links must remain active for at least 60 days after sending
  • There must be no cost, login, or extra steps required to unsubscribe

We maintain suppression lists to help you stay compliant. Do not attempt to re-add unsubscribed contacts.

5. Prohibited Content

You may not use MooseMailer to send:

  • Unsolicited bulk email (spam)
  • Phishing attempts or fraudulent content
  • Malware, viruses, or harmful attachments
  • Content that impersonates another person or brand
  • Illegal products or services
  • Pornographic or sexually explicit material
  • Hateful, violent, or extremist content
  • High-risk schemes including crypto scams, payday loans, or deceptive affiliate offers

6. Your Responsibilities

As a MooseMailer user, you agree to:

  • Maintain accurate, up-to-date contact lists
  • Keep records of how and when consent was obtained
  • Remove bounced and invalid addresses promptly
  • Monitor your sending reputation and complaint rates
  • Respond promptly to any abuse reports we forward to you
  • Comply with CASL, CAN-SPAM, GDPR, and any other applicable laws

If you manage sub-accounts or send on behalf of clients, you are responsible for ensuring they also follow this policy.

7. How We Enforce This Policy

We monitor sending activity, complaint rates, bounce rates, and spam trap hits to protect platform deliverability. If we detect a problem, we may:

  • Contact you to investigate
  • Temporarily pause your sending
  • Require you to verify your list sources
  • Suspend or terminate your account

Serious or repeated violations — especially sending to purchased lists or generating high spam complaints — may result in immediate termination without refund.

8. Reporting Abuse

If you've received unwanted email from a MooseMailer user, or if you believe someone is violating this policy, please let us know:

Include the full email (with headers if possible) so we can investigate. We take every report seriously.

9. Legal Framework

This policy is designed to comply with:

  • CASL — Canada's Anti-Spam Legislation (the strictest standard we follow)
  • CAN-SPAM — The U.S. Controlling the Assault of Non-Solicited Pornography and Marketing Act
  • GDPR — The EU General Data Protection Regulation

It is your responsibility to understand which laws apply to your sending and to remain compliant. When in doubt, follow the strictest applicable standard. If you're unsure, consult a lawyer.

Failure to comply with anti-spam laws can result in significant penalties — up to $10 million per violation under CASL.
